Introduction

These Terms and Conditions (“Terms”) govern the relationship between Nore Yachts (“the Agency”, “we”, “our”, or “us”) and any person or entity (“the Client”, “you”, or “your”) using our services to arrange or facilitate yacht charters. By making a booking, inquiry, or payment through the Agency, you agree to be bound by these Terms. Nore Yachts acts solely as an intermediary or booking agent between Clients and third-party yacht owners, operators, or management companies (“the Owners”). We do not own, operate, manage, or control any of the yachts offered.

Scope of Services

  • The Agency provides yacht charter brokerage and facilitation services.
  • We introduce Clients to yacht Owners and assist in coordinating the charter process,  including quotations, bookings, and payments.
  • The Agency is not a party to any charter agreement entered into between the Client and the owner.
  • All charters are governed by a separate Charter Agreement directly between the Client and the owner (or their representative).

Role and Liability of the Agency

  • The Agency’s role is limited to arranging and facilitating bookings on behalf of Clients.
  • The Agency does not own, operate, or maintain any yacht, crew, or associated services.
  • All details and specifications of yachts, including images, capacities, amenities, and crew qualifications, are provided by the Owners or their representatives. The Agency is not responsible for any inaccuracy or change.
The Agency accepts no liability for:
  • Accidents, injuries, losses, or damages occurring onboard or during the charter;
  • Acts or omissions of the yacht Owner, crew, or third-party suppliers;
  • Mechanical failures, weather disruptions, or force majeure events;
  • Cancellation or alteration of the charter by the Owner.

Bookings and Payments

  • All bookings are subject to availability and confirmation by the yacht Owner.
  • Upon confirmation, the Client will enter into a Charter Agreement directly with the Owner, which sets out all charter terms, conditions, and cancellation policies.
  • The Agency may collect deposits or full payments on behalf of the Owner. All such funds are held as agent for the Owner, not as property of the Agency.
  • The Agency is entitled to a commission or service fee for brokerage services, which is non-refundable once a booking is confirmed.

Client Responsibilities

  • The Client must provide accurate information and comply with all terms of the Charter Agreement.
  • The Client and their guests must follow all laws, maritime regulations, and instructions of the yacht’s captain and crew.
  • The Client is responsible for any damage or misconduct caused by themselves or their guests.
  • The Client acknowledges that participation in yacht charters involves inherent risks and assumes all such risks voluntarily.

Cancellation and Refund Policy

  • Cancellation terms are governed by the Charter Agreement between the Client and the Owner.
  • The Agency is not responsible for enforcing refunds or cancellations on behalf of either party.
  • Any Agency service fees are non-refundable once booking confirmation is issued.

Insurance

  • The Agency strongly recommends that all Clients obtain comprehensive travel, cancellation, and personal liability insurance prior to the charter.
  • Yacht Owners are required to maintain hull and liability insurance for their vessels, but the Agency does not verify or guarantee such coverage.

Force Majeure

The Agency shall not be liable for any failure to perform its obligations due to events beyond its reasonable control, including but not limited to natural disasters, weather conditions, pandemics, war, terrorism, or governmental restrictions.

Indemnity

The Client agrees to indemnify and hold harmless the Agency, its directors, employees, and affiliates from any claim, damage, loss, or expense arising out of:
  • The acts or omissions of the Client or their guests;
  • Any dispute between the Client and the yacht Owner or crew;
  • Any injury, loss, or damage occurring during the charter.

Privacy and Data Protection

The Agency collects and processes personal data in accordance with applicable privacy laws. Client information is used solely for the purpose of facilitating yacht charters and will not be shared with third parties except as required to complete a booking.

Governing Law and Jurisdiction

These Terms and any related disputes shall be governed by and construed in accordance with general principles of international commercial law. Any dispute arising under these Terms shall be finally resolved by arbitration administered by the International Chamber of Commerce (ICC) in accordance with its Arbitration Rules. The place of arbitration shall be neutral, and the arbitration shall be conducted in English.
